By accessing and using our service, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

Hired provides an AI-powered job search automation platform that:

• Discovers job opportunities based on your criteria
• Identifies hiring manager contact information
• Generates personalized job application emails
• Sends applications via your connected Gmail account
• Tracks application submissions and responses

Important: We make no guarantees regarding job placement, interview invitations, or employment success. Our service automates the application process but does not guarantee outcomes.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our service. By using Hired, you represent and warrant that you meet these requirements.

4. Account Registration and Security

To use our service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

5. Gmail Integration

Our service requires connection to your Gmail account to send job application emails. By connecting Gmail:

• You authorize us to send emails on your behalf when you explicitly trigger applications
• You confirm you have the right to use the connected Gmail account
• You understand that emails will be sent from your Gmail address
• You can revoke access at any time through your account settings or Google account settings

You are responsible for the content and consequences of emails sent through our service. We recommend reviewing generated emails before sending.

6. Credits and Billing

Credit System:

• Credits are used to perform job searches and send applications
• One credit typically equals one job application opportunity
• Credits are non-refundable once purchased
• Credits expire 30 days after purchase
• Unused credits must be used within the 30-day validity period

Payment Processing:

All payments are processed securely through Lemon Squeezy, our third-party payment processor. By making a purchase, you agree to Lemon Squeezy's terms and conditions. We do not store your payment card information.

Refund Policy: Due to the nature of our service (immediate delivery of digital services), all sales are final. Credits are non-refundable. However, if you experience technical issues preventing service use, contact support@gothired.io or call +27 71 642 6329 for assistance.

7. Acceptable Use

You agree NOT to:

• Use the service to send spam or unsolicited communications
• Provide false or misleading information in your profile or applications
• Violate any applicable laws, regulations, or third-party rights
• Attempt to access, tamper with, or use non-public areas of the service
• Interfere with or disrupt the service or servers/networks connected to the service
• Use the service to harass, abuse, or harm another person or entity
• Impersonate any person or entity or misrepresent your affiliation
• Reverse engineer, decompile, or disassemble any portion of the service
• Use automated means to access the service without our express permission

8. Intellectual Property

All content, features, and functionality of the service, including but not limited to text, graphics, logos, software, and AI-generated content, are owned by Hired or its licensors and protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your resume data and profile information. By using our service, you grant us a limited license to use this information to provide our services to you.

9. Service Availability and Modifications

We strive to provide reliable service but cannot guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue the service at any time
• Impose limits on certain features or restrict access to parts of the service
• Perform maintenance and updates as necessary

10. Limitation of Liability

To the maximum extent permitted by law, Hired shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Job search outcomes, interview results, or employment decisions
• Third-party actions or decisions based on emails sent through our service

Our total liability to you for all claims arising from your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the service will be error-free or uninterrupted
• Warranties regarding job search success or employment outcomes

12. Indemnification

You agree to indemnify, defend, and hold harmless Hired and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the service, violation of these Terms, or violation of any rights of another party.

13. Termination

We reserve the right to suspend or terminate your account and access to the service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any reason at our sole discretion

You may terminate your account at any time through your account settings. Upon termination, your right to use the service will immediately cease, but you will retain access to any unused credits until account deletion.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts located in Cape Town, South Africa.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through a prominent notice on the platform. Your continued use of the service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you should discontinue use of the service.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hired regarding the use of our service and supersede any prior agreements.
